   What is the justice delayed is justice denied?
   What is the meaning of this justice delayed is justice denied and how it affects defendants and the courtroom work group. What steps have courts and legislatures taken to deal with the problem of delay? And how effective have these steps been?

   There is an old saying: “Justice should be swift and sure.”

   Years ago, the Supreme Court ruled that defense attorneys who wanted to appeal their clients’ conviction(s) had to present all their appeals in one “package,” not file one appeal after another over a period of years.

   Many states now have automatic appeals in capital cases and do not require that all appeals be “bundled” together.

   Last year, a convicted murderer in California was executed after spending 25 years on death row due to the lengthy appeals process – one at a time.

   In many cases, a protracted appeals process may deny society the justice it seeks. Crucial witnesses may have died; the court reporter in the original trial may have died, etc.

   A “bundled” appeal may deny a convicted person the right to change lawyers. A proficient trial attorney may not be a good appellate attorney.
